Privacy and Personal Data Processing Policy

This Privacy and Personal Data Processing Policy (hereinafter – the Policy) is an integral part of the End User License Agreement between you (the User) and us (the Administration). This Policy explains who we are, for what purpose and how do we process personal data, what rights do you have providing us with any information about yourself, and how to get in touch with us if required.

We reserve the right to amend the Policies at any time and for any reason. The date of the last update of the Policy will be indicated by the “Last Update” line at the beginning of this page.

1.  Who are we?

We (Administration) are Studio Evolution Ukraine, LLC, a legal entity under the laws of Ukraine with company identification code 39834859, location: 11 Polsky descent, off 2, Odessa, 65026, Ukraine, which is the owner of the Website and is a controller in relation to the personal data processed in accordance with this Policy.

2.  What is personal data?

The term “personal data” in this Policy means any information relating to an individual, who is identified or may be identified (“data subject”). An individual who may be identified is a person who can be directly or indirectly identified, in particular by reference to an identifier, such as a name, identification number, location data, an online identifier, or by one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of this individual.

3.  What is the lawful basis for processing your personal data?

We process your personal data basing on several legal grounds, namely:

—   Your consent to the appropriate processing, as for some cases (e.g. the use of direct marketing). We receive and rely on your consent to appropriate processing (you can always withdraw your consent).

—   In case of absence of your consent, we will process your personal data only in case of need, in particular:

•   to fulfill the contract with you, or to carry out the actions necessary to enter into such a contract upon your request;

•   to fulfill our law-established obligations;

•   to enforce the legitimate interests pursued by us or third person, only in circumstances where these legitimate interests do not contradict your interests or fundamental rights and freedoms that require personal data protection;

•   to enforce public interest or during discharge of our duties;

•   to enforce legal claims rights, especially if we need your data to establish your identity, protect our interests.

4.  What data do we process?

We may process your personal and non-personal data either obtained from you, or obtained from other source, which may include:

—  information about you (name, surname and third name, home address, series and number of an identity document, telephone number or other contact information);

—  unique identifiers, such as username and password;

—  location (for example, the geographic location of your device);

—  Internet Protocol address (IP address) used to connect the device to the Internet and other personal and technical information that you provide to us during the use of the Site, including your registration information, device type and model, browser type and version, time zone, types and versions of the browser plugin, system language, operating system and platform, advertising device identifier;

—  cookie ID;

—  personal information obtained during communication with you by phone, e-mail, via the Website or in any other way (including the data we receive or you grant to us while using the Website: registering to receive our news, being interested in our products, placing an order, participating in a promotion, advertisement or survey, contacting us to report a problem, etc.);

—  information about the presence or absence of the purchased Studio Evolution products (model, serial number, HWID product code and method of use (personal use or use in club / commercial use), history of your orders for Studio Evolution products;

—  your other personal data that we need to process in order to conclude or execute an agreement with you;

—  personal information and preferences in case such data is necessary for organizing and managing these events (for example, your wishes and requests in addition to the Studio Evolution karaoke product catalogue);

 

—  information about your visit, including full unique resource locators (URLs), history of visits and movements on our Website, history of transition from our site (including date and time), products that you have viewed or searched for, page response time, loading errors, time spent on certain pages, information about the activity on the page (for example, scrolling, clicks and mouse cursor hovering), ways to navigate from the page, as well as the phone number or social network icon that you used to communicate with us.

5.  In which case we process your data?

We may process your personal data if:

—  you are our customer (buyer) or supplier (or are interested in becoming so);

—  you use our Website or products;

—  you work for our customer (buyer) or supplier, or someone who uses our products;

—  you are a client (or you work for a client), to whom we want to tell about our products or offer them;

—  you are our employee, contractor or interested in working with us.

We consciously do not collect personal data from children under the age of 18, nor do we offer them products. If we become aware that a person under 18 has provided us with personal data without parental consent, we will take steps to remove such information.

6.  Why do we process data?

We do not collect any personal data if it is not required to achieve the goals defined by this Policy. We collect and process your personal data solely for the purpose of:

—  administering the Website, personal account, your account (s), ensuring your access to the Website and its functionality and internal processing, including correction of deficiencies, data analysis, testing, research, collection of statistics and opinion polls;

—  improvement of our Website and experience of its use, ensuring the presentation of content in the most effective way for you and for your device;

—  advertisements, offers and sales of Studio Evolution products, selection of current and necessary updates for the Studio Evolution products you purchased and liked;

—  evaluation and understanding of the effectiveness of advertising that we demonstrate to you and others, as well as for placing current advertising;

—  sending upon your consent an information, including advertising materials (by e-mail, telephone, and messages on the Website) and for personalizing the newsletter;

—  management of our relationships with customers, suppliers and other users of the products and Website.

7.  How long we keep personal data?

The data received from you is saved for the period necessary to achieve the goal for which it was collected, after which the data is deleted or transferred to the archive, except for cases where further processing is necessary to comply with the obligations that we have undertaken, or for other legitimate goals. If other term does not follow from the purpose of processing your personal data, we will process it up to three years from the date of collection.

We will delete your personal data after you delete all of your accounts. In addition, you can withdraw your consent to the processing of personal data.

8.  Disclosure to third parties

We may transfer your personal data to any member of the Studio Evolution group of companies, directly or indirectly related companies, subsidiaries and their subsidiaries.

We may transfer your personal data to third parties, including our business partners, suppliers and subcontractors, if this is necessary to achieve the purpose of processing your data; our auditors, legal advisors and other professional advisors or service providers.

We may share data obtained through our Website with providers of analytics and search engines that help us improve and optimize our Website with regard to the use of cookies on this policy.

We may disclose your personal data to third parties if such disclosure is required by applicable law.

9.  Cookie policy

When you use our Website, we place cookie files on your device – small fragments of text sent to the device by the Website. We will take all necessary measures to ensure that all relevant security measures for your data are met.

—  the right to access your personal data and the right to request a copy of personal data that we hold about you (for this, please contact us in any way convenient for you);

—  the right to correct personal data, fill in any incomplete personal data that we process regarding your person;

—  the right to delete data we no longer have the right to process or the right to “be forgotten”;

—  the right to restrict or block data processing;

—  the right to transfer data to another service (to another controller), to store personal data on a personal device;

—  the right to make objection to any processing of personal data that we process on the basis of ensuring the legitimate interests, if our basis for basic processing exceed the scope of your interests, rights and freedoms;

—  the right not to be a subject of automated decision-making and profiling and to personally influence automated collection and embossing systems;

—  the right to withdraw your consent to the processing of personal data, if the processing is carried out on the basis of consent (for more information on the withdrawal of consent);

—  the right to submit a complaint to us or contact the control authorities of the country in which you live or work;

—  the right to require us not to process your personal data for marketing purposes.
